Feedback published and final intellectual property fees confirmed

We have published feedback on our consultation on fees for Jersey’s new trade marks, patents and designs framework. The consultation sought views on the proposed fees that will support the operation of Jersey’s modernised intellectual property registry.

Summary of feedback

We received two responses:

• one respondent supported all aspects of the proposed fees and suggested no changes
• the other respondent asked several practical questions about how Jersey’s patents and designs framework will work, especially where rights automatically extend to Jersey under international arrangements

Neither response raised concerns about the level of the proposed fees, their implementation, or any potential impacts on users.

The consultation also gave us an opportunity to clarify how certain patent and design rights operate in Jersey and how the new framework will apply in practice.

Our response

Having considered the feedback, we are confident the proposed fees are fair and proportionate for Jersey’s intellectual property framework. The responses confirmed that the fees are consistent with comparable services and will support the new registry.

We also clarified that the new patent and design fees apply only if a Jersey re-registration process is needed. Rights that automatically extend to Jersey through international arrangements do not require a separate application and are not subject to these fees.

Next steps

The new trade marks, patents and designs fees will come into effect on 1 August 2026.

The consultation also highlighted areas where additional guidance and communication could better support users of the new framework. We will take this into account as we move towards implementation.
